Why did they put this on a 50a breaker ??

That is the heater and control panel. It likely does not include the current drawn by pump motor(s) and accessories like an ozonator.
 
No idea, 40A would have been the right size. Could be the installer was used to installing 50A for tubs as that is the normal size circuit for a hot tub and just didn't read the nameplate. What size wire did they run?

Yea they want a 240 but the cord is hooked up to be 120

You would need to check and see if the tub is allowed to be cord/plug connected when run on 240V. There would have to be a circuit ran to a box with a 40 or 50A receptacle as you can't wire straight to a panel with SO cord.

I was going to run new wires car flex or seal tight and run it to a 50a gfci disconnect that has the breaker inside

That's what I would do.
You also need to check and see if something like dip switches or a jumper needs to be changed to run it on 240V.

So when I looked all I gotta do is put the other hot on line 2 to make 220 or 240.
It’s hooked up as 120v right now. Why would u need a jumper?

Probably not if the diagram doesn't show one. Sounds like you just replace the neutral with another hot on line 2.
 
A typical convertible spa can only run the heat on low pump speed, and heat at 1/4th the power (1.5kw).

On 240v, the heat and the high pump speed can run simultaneously, and can heat at full capacity (6kw).

There is usually a jumper for the control transformer, and wiring for the motor(s) for the supply voltage.
