I have 120/208V house switchboard. Its in the basement with one other switchboard which powers the residential apartment complex on level 2 to level 4. On level 1 space is divided for new commercial tenants and to power the tenant tap is being made from the line side compartment of house switchboard to service disconnect #3. Load side of service disconnect is a wire trough bus which taps individual disconnect to tenants. The house switchboard also power common spaces level 2 to level 4.

The question is house switchboard allowed by code to power commercial tenant space or I need to tap off of the residential switchboard or new switchboard is required?

In my opinion, it's not so much a code issue as a metering/billing issue. Will the owner be paying for the commercial tenant's usage, or will the tenant be paying for the house loads? If the latter, what happens to the house panel if the tenant leaves and has their account closed?
