Instant hot water heater(electric)

I seen a instant hot water heater mounted on a wall directory above a sink and near a bath tub.(it’s a grooming facility for dogs). I assume the water heater should be treated as anything else, receptacles ,hanging lights, etc.? Not belong allowed within 3ft horizontal of the rim and 8ft vertical. Forgot to mention it was surface mounted. I realize why they probably done it keeping the water piping all in one wall and area, but doesn’t seem right to me.
 
I can't think of anything that would prohibit it.

Maybe someone else will come up with a section that I'm overlooking.
