Is 10/3 cable ok on 40amp breaker for Mini-Split?

Can I use 10/3 wire (<60ft) on a 40amp breaker that is powering a 220V MXZ-5C42NA2 heat pump condenser? The manual says the min current draw is 31.9amps and recommend fuse size is 40amp. I Have 10/4 cable.
