Is this a detached garage?

It is like a hole dug under small hill with house on top. I do not think there is a foundation connecting it to house.

I agree detached. Generally around here there would need to be a roof attaching one to the other. Had one where they tried to call it attached because there was a wood deck between them. I called the state building engineers and they said -- detached
 
I think the code requiring ground rods for an outbuildings with more than 2 circuits is due to their foundations not being connected. Equipotential?

Equipotential yes. Foundations not attached as reason, IDK... will likely never know. ;)
 
I'm sure there is probably a 2 hour finish between the two "structures" as well, that usually allows you to call something a separate building.
