Notice the flex at the top of this picture.
Customer says it is a wet location and we must use liquidtight.
We say it's not and if it was we are using thhn/thwn and there is nothing wrong or a code violation.
It is the exterior of a wallmount Marvair A/C unit.
What do you say?
Please cite code sections or good arguments.

Is that FMC?

348.12 Uses Not Permitted. FMC shall not be used in the
following:
(1) In wet locations

Location, Wet. Installations underground or in concrete
slabs or masonry in direct contact with the earth; in locations
subject to saturation with water or other liquids, such
as vehicle washing areas; and in unprotected locations exposed
to weather.

It appears to me that what you have is a damp location, and FMC is not prohibited there.

If it was factory installed this would not even be a post.
I would have told customer to take it up with Marvair.
Location, Damp. Locations protected from weather and
not subject to saturation with water or other liquids but
subject to moderate degrees of moisture. Examples of such
locations include partially protected locations under canopies,
marquees, roofed open porches, and like locations,
and interior locations subject to moderate degrees of moisture,
such as some basements, some barns, and some coldstorage
warehouses
. I agree it would not be a wet location but a damp location where it is permitted. Have the customer pay attention to
not subject to saturation with water or other liquids
The customer is not us is it?:?
