Is this safe?

I have an 8-watt under-sink tankless water heater and replaced it with an 11W (rheen) 220 volts and max amperage of 45. I have #8 Romex with a 40 amp double breaker. I should use #6 with a 50amp breaker. I use the sink for 15-20 minutes a day to wash the dishes. The breaker terminal gets to 106(f) 38(c) after 15 minutes of continuous use. If I used it continually all day I would redo it, but I hope 15 to 20 minutes will be safe. If the 40amp breaker ever tripped I would replace the line. Is this safe?
