J.B. Vs Trough Vs Wire Way

We wanted to use a 12*12*30 above panel. Building guy said no. He told us it would be considered a wire way and a wire way is not permitted above a panel. We meed to move a panel and needed to capture circuits for that panel, no feed will be in panel. Where can I find this info in code.

The building guy is wrong. You can't put "foreign" equipment above a panel, but a wireway is not foreign to the electrical installation. 110.26(E).

But if the panel is flush mounted in the wall and the box is surface mounted, could it be considered a violation of the maintenance access space rather than the dedicated electrical space?

You're allowed 6" of encroachment into the working space. If the wireway is 12" deep and the panel is 6" you're good otherwise you can build the panel out off of the wall if it's less than 6" deep.
