kitchen lighting title 24 high efficacy

Hi,
Just met with a new customer this evening.
We are to install LED strip type lights for general lighting. Plus over the peninsula the wish to install some incandescent pendants.

The peninsula has a sink and counter on either side.

The peninsula wide enough and overhang allowing some bar stools.
My quistion is do you think the are of the counter where you can sit with a bar stool. could be considered other than kitchen so we do not need to install high efficacy lights such as pendants?

Probably a question for the AHJ. But if it seems it is part of the kitchen, then it is. Thus you have to follow title 24.

The problem is the client wants incandescent and they want what they want.

I would like to follow the rule. Not that I am a sticker on rules or anything. I'd like to say I did it right.
 
I was looking at the rule and it says a nook can be a separate area.
Do you think that you can split the peninsula down the length one side kitchen and one side nook. There are no walls surrounding the nook.

The customer may get what they want after inspection.

But for now and for final inspection you need to satisfy the AHJ and title 24.
