I have shown on drawings the control switch for a residential garbage disposer on the wall "behind" the kitchen sink. A contractor has told me that a switch or receptacle cannot be behind the sink but has not stated what NEC section prohibits this. The local AHJ plan review staff agree there is no such limitation.

Question: Does the NEC have a requirement for the MINIMUM spacing from a sink (or a lavatory, for the bathroom) for a switch or receptacle?

I personally would mount the device off to the side of the sink in the wall for ease of installation.Also isn't there usually a window over the sink so that the homeowner can watch the grass grow while washing dishes? :)

Thanks to all who commented. I have also finally been able to consult with the NFPA NEC staff who also confirmed that they is no minimum distance from the sink to a receptacle or switch. Their rational is that the device is either a GFCI receptacle or a dead-front or grounded switch.
