The State Fire Code - typically state fire codes mandate the installation of 'legally required stand by systems' due to building height [I just asked our fire captain].

The NEC tells you the requirements of the system, the fire marshall mandates the installation. Other state agencies mandate for other types of occupancies - hospitals, schools, prisons, etc.

I don't see a relationship between these two. If the building's design calls for a battery backup ballast, then it would be to provide egress lighting. If indeed egress lighting is required, and if you prefer to use a generator instead of the battery backup method, then that portion of the generator's distribution system would be classified as "emergency," and would be governed by NEC 700, and not "legally required standby," which would instead be governed by NEC 701.
 
The building codes also will specify when legally required standby power is required.

Section 2702 of the 2006 IBC specifys what type of power is required for certain applications.

For instance 2702.2.2 Smoke control systems are required to be powered by legally required standby power not emergency power.
