Liability for fixing code violations that pass inspection

Forgive me if this is in the wrong forum.

Recently had a homeowoner doing an owner/builder permit solar install on a detached garage fail inspection because the existing grounded conductor (#6 AWG Neutral) going from the MSP to the detached garage sub-panel was identified at the terminations with white tape instead of being a fully white wire. (we had to add a disconnect on this run near the meter so we identified the existing wire similarly in the disco).

This wire was from the original permitted garage install and passed inspection...10 years ago.

The inspector showed me the code section (200.6) which I agree with, and suggested we get previous electrician to correct the violation and pull new white wire at their expense (it is a ~65ft trenched run).

We went ahead and pulled the new wire ourselves because we had to run CT cable anyway and I figured this other guy would be weeks before he was willing to come, but my question is, would the previous electrician have been obligated to come out?

More generally, if an inspector passes a job, doesn't the AHJ now hold liability for any missed violations if those violations are discovered later on, like in a new permit situation similar to ours? We never looked up the old EC but I figured he would have told us to pound sand.
 
I would say the AHJ was being a PIA and didn't need to flag the minor violation in the existing installation. If the installation is over a year old and there were no extended warranty given to the homeowner, then they would not be obligated to change it. Particularly because it already has passed the inspection. I think this requirement hit in the early 90s? So maybe the install was done before it was required?
 
Our contract carves out several items the customer is responsible for. Undiggable rock, customer owned unlocated utilities, and changes required by the inspector to our (obviously perfect code compliant) plans.

We have not had to use any of those clauses yet, but this would seem like a clear case of it.
 
White tape on a black wire was common ten years ago as many supply houses didn’t have 6 awg in white.
It’s long been a requirement on 6 and smaller being white
