Could you describe the situation some more?

A single snap switch to act as a means of disconnect residential, well sure.

Industrial or commerical might be tricker... depends on the application.

Means of access, or maintained accessible and maintaining clear comes could come into play considering the I and C side of things.

The situation is this; there are 2 switches mounted horizontally (each in their own outlet box) on the wall directly behind the sink in residential kitchen. One controls a light over the sink and the other controls the garbage disposal. This house is probably 50(?) years old. The current owners are selling and the issue of the switch placement came up from the prospective buyers. I would not use this space for wiring switches or for that matter receptacles. I can't find where this location is not allowed though.

Depending on dimensions, a receptacle could be required by NEC in the same spot that you wouldn't put one.

Not the best design to locate switches behind the sink, but not against NEC. You might suggest

an air switch for the disposal & move the light switch $$$$
