We have a 208v lighting circuit on circuits 5 & 7 for 208 light fixtures. We also have a 120V emergency light and exit light fixtures connected to circuit 5 with a neutral.

Is this arrangment a legal per code?
 
It's legal and perfectly legit. Must have a two pole breaker.

Correct, 210.4(C) Exception #2 requires a common trip two pole breaker.

(C) Line-to-Neutral Loads. Multiwire branch circuits
shall supply only line-to-neutral loads.
Exception No. 1: A multiwire branch circuit that supplies
only one utilization equipment.
Exception No. 2: Where all ungrounded conductors of the
multiwire branch circuit are opened simultaneously by the
branch-circuit overcurrent device.

in addition to what others stated 700.12(F) the normal lighting circuit #5 would have to be the lighting circuit in the area of the emergency lights. By that I mean you cannot extend the EM portion of circuit #5 into an area not served by the lighting circuit 5&7.If your concern is an unbalance aren't most EM lights multi tap, do you not have the ability to supply the fixture 208 volts

Hi, I'm also from NYC and could not find amendment to 700.12(F) that would indicate the need for a dedicated branch circuit for exit or emergency lights. Everybody runs an individual circuit for that but I think its not only waste of AC cable and labour but also code violation.
Can you back up your statement with code refrence?
