Yes, if there is not a shower head. The space above the tub is not considered a damp area.

I am assuming (usually a bad thing to do) that you mean Hydromassage Bathtub.
680.72 refers you to 410.4(D) which instructs you what can and cannot be installed in that location.

Hydromassage tub or plain tub no difference. Section 410.4(D) pertains to pendants, track lighting or paddle fans, not recess.

It does not matter if the cans are eight feet or not they are allowed without an enclosed trim.

Do you think this is why the manufacturers make enclosed gasketed recessed light trims and call them shower lights?

Are you 'splitting hairs' here, or is that really the intent of this. Is there not the possibility of say, kids splashing in the tub and possibly the water could hit the bulb. I know when my children were younger, I always got in trouble for splashing too much with the kiddles in the tub.
