Lights on 1 switch from 2 breaker panels

Was just tracing out a lighting issue with 2 runs of florescent lights that half the lights were off controlled by a double switch similar to this from the front:

Opened up switch and found that the upper control had no power on it at all and it seemed to have a seperate supply wire. Traced that and found it going to entirely seperate circuit panel box (a sub panel that was being replaced and was currently off). Now my question is, to me that seems to be a code violation and not really sure how they got it to work in the first place, and either way seems to be unsafe. Is this a code violation? What number? If not what number? To me if it was to be controlled by 2 circuits it would be required to be side by side and handle tied so common off.
 
That is what I thought and I can't comply with 210.7 with sources being in 2 different panels. Wanted some confirmation that I wasn't seeing it wrong or missing something that might have allowed this at some time.
