I have noticed that many meter/panel combos have space for 12 breakers. On the info posted on the panel it says to only use 2pole breakers (probably for the 6 movements of the hand rule). If this provision is not part of the actual listing of the panel amd the inspector sees single pole breakers installed, is it an enforcable violation if there are less than 6 breakers installed? Please cite a reference if you say yes.

Hey Ryan, I just got back from San Diego where we were writing the responses to the comments for the 2005 Code.

To answer your question, you are permitted to use single pole breakers with handle ties. 230.71(B) covers your question. Even if additional spaces are in the panelboard, it shouldn't be red tagged for some future violation. If that were the case, a #12 with a 20 ampere breaker should be red tagged because the breaker could be replaced with a 40 ampere breaker. HMMM :) :D

So if i use a 4o circuit ML panel and only install 6 breakers or throws would you pass that.I think not,because it is designed to handle 34 more breakers and we all know others will get added.If the panel says 6 220 volt breakers and you put in 12 singles with ties i might go for it.But your only permitted to use the breakers it listed.
This is why we can't interchange brands of breakers even if they fit.

Whenever a "six disconnect" rule panel is being considered remember it must meet all provisions of NEC 408-14 and 408-15.

Quote from a Square D QO13040L200G panel (single phase, 30 space, 40 circuit, 200A main lug only) :

UL Listed as suitable for service entrance equipment (neutral bonded at time of installation)when not more than six service disconnecting means are provide and when not used as a lighting and appliance branch circuit panelboard.

The meter/panel combo's with 12 spaces are for six or less, service disconnects.

The minimum service disconnect is a two pole 30 amp breaker.

Nothing says one has to use all available poles of a 2-pole. It would trip fine if only one side were connected...
