Load Center as disconnect

Is it compliant to take an existing #2al sec single circuit furnace circuit and use it to feed a 6 circuit load center and then install a 2 pole 30 and a 2 pole 60 to feed the replacement 2 circuit furnace? The load center would have no neutral or neutral loads, but would have 2 unused breaker spaces. I have seen this situation before and someone added a 1 pole breaker and used the ground for a neutral.

From what I see, you would have a sub panel. If so a four wire feed would be

needed.

Since you do not need a neutral what you propose is fine. What someone may do in the future is irrelevant.
