The situation is this:

On a new construction site, the main switchboard has been energized - 480v
3 phase, 4000 amp capacity

There are 12 branch circuit breakers which range in size from 1600 to 100 amps.

One of the 100 amp CB's is being used as a supply to a temp ltng panel. The other cb's are in place and therefore are hot. The EC has placed "yellow phase tape" across each breaker handle as his "safety measure". Several of these feeders are disconnected in the sub-panel. The electrical room is at times unattended. I referenced OSHA29 CFR1926 Construction Industry Regulations and found under lock out tag out, the construction industry is exempt from the regs regarding lo/to. On page 373 under 1910.147 (the control of hazardous energy) (a) 1 (ii) "this standard does not cover the following" [A] Construction agricultural and maritime employment.

My question is: what can I reference to require the GC/EC to, at the very least, tag out the breakers not in use?

This is why we don't release power early to a building. We make the EC lock out the breakers with locks he provides and I hold the keys. If I use my locks the EC and GC sign a paper stating that the removal of these locks (again I have the keys) is considered "destruction of city property" and is a punishable offense.

Our local ordinace reads as follows: A conditional electrical service connection may be authorized by the building official when in the opinion of the building official the need for such connection exists and such connection cannot be achieved following the standard adopted policy or process. Conditional electrical service may be terminated at the discretion of the building official.

You are looking in the wrong place. The OSHA construction standard is CFR 1926. Electrical is Subpart K.

1926.417(b)

Equipment and circuits. Equipment or circuits that are deenergized shall be rendered inoperative and shall have tags attached at all points where such equipment or circuits can be energized.
