Luminaires supported by vegetation?

In NJ we are using 2017 nec.
I'm finding it's not permissable for supporting conductor spans from vegetation but nothing about supporting lighting fixtures. I vaguely remember you could, then you couldn't, then I think you could again. A google search shows 410.16 means of support, fixtures and equipment is permitted to be supported on trees (might have been 2008). 2017- 410.16 is lighting in closet.

Reason I ask is I visited a job today and they have a flood light on a tree, the tree is right on the edge of a pond. Is the light on the tree ok? and Does the light on the tree by the pond have to be treated as lighting by a pool?

Light on tree is ok if fed underground.
The pond is not a pool, obviously, but if swimming is taking place then I would follow pool electrical requirements.
 
I agree with Tom, what you cannot do is span from tree to tree with something like a messenger supported cable which is something that is often done at ski resorts.
 
If it were a fountain or decorative pool, article 680 would apply. Other bodies of water are covered by article 682.

You may have to contend with vertical clearance requirements if it's over the pool. Off the top of my head, I'm not sure if that's just "over the water," or if the range of those clearance requirements extend a certain distance beyond the edge of the water...
