main breaker after main disconnect

Large residential service with 400 amp fused disconnect. Feeders out of this into trough and then taps to 2- 200 amp distribution panels knippled out of top of trough.
Found a code in tap rules that says the tap conductors do not need to be protected if less than 10 feet.
Does this indicate you could save the cost of the main breakers in the 200 amp panels and go with main lug type?

408.36 will still require the panel to be protected at it's rating, the flip of this would be that you could have eliminated the 400 amp fused disconnect and just installed a 320 meter with double lugs and as long as the panels are grouped 230.40 Exception 2 would have been covered.
