Main breaker/Main lug

Every main breaker load center I have seen has a non-removable main breaker. Is it a code violation to install a main lug only panel, but use a 2-pole stab in breaker as the panel?s main breaker? I have always been under the assumption that this is a code violation but have been unable to find the specific code article. Would I be correct in assuming that the panel is being used other than what it is listed for and therefor be in violation of listing?

It is not a code violation as long as you also install the retaining clip the manufacture provides that holds the breaker so it cannot be removed. see 408.16(F)

It's very basic but it does cover the topic you are discussing and should adequately clear up the question. It takes well less than twenty minutes to run through it. This module does include code citations.

Thanks Grant,
That is just what I was looking for. I don?t recall however seeing a clip that comes with MLO panels. I assume that you mean you can purchase a conversion kit/clip for the specific panel? Also I see an awful lot of this scenario in commercial buildings. Is it safe to assume that bolt on breakers covers this topic? Thanks again.

2002 NEC 480.16(F) Back-Fed Devices. Plug-in-type overcurrent protection devices or plug-in type-main lug assemblies that are backfed and used to terminate field-installed ungrounded supply conductors shall be secured in place by an additional fastener that requires other than a pull to release the device from the mounting means on the panel.
The "bolt-on" or "screw-on" commercial breakers do not require any additional clips.
The above is referring to "plug-in" type.

George, 50A is the smallest main you can get for the convertable QO/Hom MLO panels.

[I just picked up a 60A main a few days ago for a subpanel disconnect (didn't want to burn two slots for a backfed disconnect) and researched what was available and saw the 50A in the list]
