Main breaker requirement

I have a bit of a unique situation concerning a main breaker. What is being asked is to separate 2 sections of gear by removing the bus in between the 2 sections of a 480V 1600a GE Spectra gear. One section has the 1600A main breaker service disconnect and the other section is a MDP with multiple breakers. Engineer wants to take wires from the 1600A breaker to feed an ATS, then feed from the ATS back to the second section of gear that was disconnected. The transfer switch will be in sight of the service disconnect, I am concerned if the second section of gear we are re feeding out of the transfer switch will now need a main breaker installed?
 
Altering switchgear is always questionable but overlooking that is the ATS rated 1600 amps
 
ATS are often installed feeding main lug only equipment. The protection comes from the OCPD which feed the Normal and Alternate sides of the ATS.

Your hard part is going to be the addition of 1600A of lugs instead bussing within the existing switchboard structure.

Seems to me you would want a disconnect in case you had to shutdown the emergency power for some reason in the switch gear. Of course you could kill the main in the generator but that is outside.

The physical location of a disconnect, for an ATS or switchboard, is a design choice.
