Main PDisconnect Panel in the Ceiling?

Just saw a 100-amp main circuit breaker panel (just the main - there are other downstream panels) in the ceiling of the basement of a home. The panel faces the floor and there is a latched, but not locked, hatch door coveing it. The panel was within 78" of the finished floor.
Is this legit?

Lady,
I agree with you on this one. I don't think that either of the sections cited by Pierre apply to a panel installed face down.

The panel was in the ceiling, with the main disconnect facing down towards the floor.

So does 240.33 really apply, because it appears to be a rotated panel (90 degrees)?

I heard an interesting explaination for the horizonatal and vertial panel installation requirements by Alan Marche of Sq D. He said the orginal code language in 1928 for horizontal was panels installed in a ceiling. This was the way panels were intstalled at that time, the code changed to only allow vertical installations...

I have seen many "Edison Base" fuse panels in ceilings. The homes were built in the 20's and 30's.

240.33 says enclosures for overcurrent devices shall be mounted in a vertical position "unless that it is shown to be impracticable."....? How to show that? What argument works when someone wants to mount it horizontally?

I do not have my code book in front of me, but I do not recall seeing any verbage in the section that says walls only. So how is it determined from the language as written that this does not pertain to ceilings?
If in a ceiling how does one orient the breaker to the 'up' position?
