I know this has been discussed before so bear with me. I was at a code update course last night and the topic of wiring methods on manufactured equipment came up.
An inspector wanted to fail a job because a rooftop unit had FMC in a wet location (ok under previous code cycles but not the 2008). The manufacturer insisted it was OK because they FMC contained wet location rated conductors. So the inspector had no choice but to pass the job.
I don't think the inspector had a right to question the unit in the first place.
Does the inspector over step his authority by looking at the manufacturer installed wiring methods on the HVAC unit?
