I am not from NYC but just down the road a bit in DC. Under our DCMR District of Columbia Municipal Regulations All Wire sizes must be Identified where accesible ie. terminations,Junction and Pull boxes, etc. "Tape is acceptable" 208/120 Black, Red, Blue, white and 480/277 Brown, Orange, Yellow and Gray. Its a take off from 210.5(C) but must use the specific colors. I have heard NYC has the same requirement. Hope this helped.
 
Using the NEC, the remarking of the phase conductors would depend on what the singage that is required by 210.5(C) says. Assuming that there is more than one voltage system in the building, the method of identifing the conductors of the different voltage systems must be posted at each branch circuit panel. Only the posted method would be premitted to be used to identify what system the conductor is part of.

If the OP is asking if you can re-phase ungrounded conductors of any size than I believe the answer is yes. Although I personally think re-phasing smaller wire is scabby.
200.6 restricts only #6 or smaller "grounded" conductors from being re-identified.
