Maximum sub panel hieght

Is there a maximum height that subpanels can be mounted.

The situation - I did a walk thru an noticed a subpanel (MLO) mounted approx 10' above floor level, however the main circuit breaker feeding the panel is at approx 5'.

The cb's in the sub panel are not used for switching circuits.

Is this a code violation ?

404.8 Accessibility and Grouping.
(A) Location. All switches and circuit breakers used as switches shall be located so that they may be operated from a readily accessible place. They shall be installed so that the center of the grip of the operating handle of the switch or circuit breaker, when in its highest position, is not more than 6ft 7in. above the floor or working platform. (quoted from the 2002 NEC)

The highest breaker in the panel will dictate the maximum height of the panel. The exceptions to this section do not apply to this case.
There is no minimum height requirement in the NEC.
