MC Application "Subject to Damage"?

Scenario 1:

An older residential building retrofitted with MC cable. The outlets on the second floor are surface mounted at about a 12" height from the floor, an exposed section of MC cable is surface mounted coming out the floor into the receptacle J box, properly supported and all. Would this be acceptable practice under 330.12? (Ideally EMT would be best).

Scenario 2:

Similar to above but exposed cable travels roughly 48-52" from floor, surface mounted feeding a sink side GFCI. Cable is more than 3' from bath tub, 1' from toilet and sink. Is this considered a "Damp" in reference to 330.10(A).10? Again I would have opted for EMT.

"Subject to physical damage" is open to interpretation.

And imo the area described in the bathroom isn't considered a damp location.
 
I would look carefully at the cable and check the UL whitebook section PJAZ and PJOX (connectors) as there are many types of MC cable and connectors these days, even for damp and wet locations.
