MC Cable secured to sheetrock above grid ceiling

MC Cable secured to fire rated assembly above a grid ceiling, using 1/2'' EMT straps. (2) layers of 5/8'' sheetrock on underside of structural framing for a one hour assembly between 1st and 2nd floor. See picture below

The inspector says the MC cable must be above the sheetrock and ran within the joists.

I do not see anything in the NEC that would prevent this, and I believe the screws through the fire rated assembly do not compromise the fire rating per the IBC.

It's not an NEC violation. Sounds like the inspector is confusing the rules for NM above a drop ceiling with the rules for MC.

This inspector is incorrect. MC cable is permitted above a drop ceiling.

That's the standard for feeding daisy chained lights. Not the emt straps though that's a bit silly but will still provide support.
