MC in commercial/residential building

I have a question someone might be able to help me with. I have 2 story building with the 1st floor being a commercial area, and the 2nd floor being a residential apartment. The 2-hour fire rating has been completed between the 1st and 2nd floor. Now my question is can the 2nd floor be wired with romex since it is now residential and the 2-hour fire rating has been accomplished, or does the entire building need to be wired in MC like the 1st floor? Thank you in advance for your help.

Depends on state and local code requirements.
Generally NM can be used in any location allowed in 334.10 and not prohibited in 334.12. MC usage and limitations per 330.10 and 330.12.
