Mc In Concrete

Hello I was once in a job where the foreman asked the workers to install MC in concrete to supply 120V receptacles for a room. The jumper was missed in the concrete phase so the foreman. told the workers to use MC in the concrete and tape it with 10Mil Tape is this legal? wouldn't they use rigid pvc mc?
 
seemingly makes a difference if it a ground level slab (wet location) or upper level slab.
which did you have ?
 
In reading 330.10 I thought it made a difference (wet location vs dry) but 330.12 requires it to be identified for direct burial.\
He had the right idea as MC identifed for burail has an overall PVC jacket but it needs to be a listed cable not "home-made".
 
We have installed miles of PVC jacketed MC cable in poured decks but as Augie stated it needs to be in a listed cable assembly. A short jumper with tape will probably last longer than the foreman will live.
