Looking at it, it seems that locking device not designed to go with the breaker installed. The double pole handle tie looks like it would prevent actuation of the lock mechanism in either position. That looks like it might be designed for a different panel.
 
I do not see where the lock (padlock) would go to allow it to be used as a lockable disconnect.
It looks like there is a padlock hasp in the lower left corner of the breaker. It is pointing straight at the camera but you can see how the metal is cut around it.

This looks like a device that provides both a Lock On and a Lock Off action.

It is designed for Siemens and fits nicely on Eaton BR breakers as well.
