1) What section of the NEC states I can use the capacities on the cut sheets?
2) What minimum size ground can I use? For example, if I had an 400A feed can I use smaller than #3 ground?

The ampacity is based on section 310.15. Aren't you using the copper jacket as the EGC?

332.80 Ampacity. The ampacity of Type MI cable shall be
determined in accordance with 310.15. The conductor tem-
perature at the end seal fitting shall not exceed the tempera-
ture rating of the listed end seal fitting, and the installation
shall not exceed the temperature ratings of terminations or
equipment.

That would make sense. I'm not that experienced with MI so I didn't really think of that as an option.

Are you using single conductor or multi conductor MI?

If you are using single conductor MI keep in mind you need to deal with the requiments found in 300.20(B).
