Minimum Rating of Disconnect

I found an old post on this but it didn't exactly answer my question. I found in NEC 225.39 disconnects must have a minimum size as stated. I am assuming this applies to outside branch circuits and feeders because that's what section it's in. I also found this requirement under services. Is there a similar requirement for indoor feeders? Can I have a 40A subfed panel?

Yes you can. Say 40a 2pole at main panel,4,#8's to a small 100a 8 circuit MLO panel.
