Minimum size conductor

Is it legal to use a 14 gauge wire in a commercial kitchen? The load is 10.4 amps. I thought somewhere along the line I was taught 12 gauge was the minimum regardless of the load in commercial buildings.
 
That's one of those old wifes tales we talk about from time to time, i.e., you can't put receptecales and lights on the same circuit in commercial, a j-box is required every 100', everything in commercial has to be 20 amps, etc.
 
I agree with what the others have already said.

This is one of those myths that get passes down from journeyman to apprentice without any real code backing, just "Thats what we have always done" thinking.
