I'm going to do a service upgrade . Right now the service disconnect is a 40amp bkr #8 awg feeding a sub panel that has 6 20amp bkr and one 40amp which feeds the whole house. Can i just replace the disc.panel put the 40amp back to feed the subpanel again and meet code req. cause it's an existing installation.

I would say yes if, the load at the sub panel does not exceed 40A and the feeder conductors to that panel is 4-wire with the grounds and neutrals separated.
