mixed wire on hvac tap

I have a question, on an inside hvac unit that is fed with #6/2 that has a tap made with #12/2 to feed a 240V condensation pump, would somebody tell me that this is wrong? It's been a long day and my eyes are about to give out from looking through the codebook. The manufacturer's instructions on this are clear in which a separate branch circuit is to be pulled for the cond.pump, so I could cite 110.3(B), thanks in advance.:smile:
 
In other words, to be a legal tap, the first thing the #12 must land on is an OCPD sized to protect it.
