MV-105 Cable and PVC Conduit

I understand that Carlon and other manufacturer's of PVC produce only 90 degree C. rated conduit and that it is a code violation to install 105 degree C. rated conductors as the temperature rating of the conductor exceeds that of the conduit. Refer to 2002 NEC 352.12(E). As it appears the industry standard for EPR cable is MV-105, does this prohibit installing this cable in PVC?

The Carlon Technical Data says for use with 90C conductors. It sounds like 90C is the max.

Exception 2005 NEC

In the 2005 NEC, there is an exception to 352.12(E) that reads,

" Exception: Conductors or cables rated at a temperature higher than the RNC listed temperature rating shall be permitted to be installed in RNC, provided they are not operated at a temperature higher than the RNC listed temperature rating."
 
I was aware of this exception. But the 2005 NEC exception doesn't apply to projects subject to review by the State of California Division of the State Architect. We are currently governed by the 2004 CEC, which is the 2001 NEC adopted with California amendments. Any other thoughts?
 
The exception in the 05 is a result of a proposal citing that the 105 degree cable is not used at load current levels that would cause the skin temp of the cable to exceed 90 degree C.
 
The terminals of the MV equipment are rated for 90 deg C anyway. The 105 temp rating can be used for derating of ampacity, but you cannot operate them above 90 in this type of installation.

Do ductbank heating calcs to properly determine.
