MWBC's again - Sorry

I know that several cycles ago all 15 and 20A MWBC's were required to be protected with a 2-P breaker. However, in any of the CEU classes I've taken over the last several years I've been told that they are not required when upgrading a service - only on new construction (at least here in NJ). I had a service upgrade inspected yesterday and the inspector told me that it was required but I objected. I told him that while I understand the reasoning for the 2-P breaker it was not required on a service upgrade. He passed the inspection but I'm wondering if anyone else is running into this with EI's, especially in NJ.

I used to buy a bag of handle ties and use them with single pole CB's on service upgrades. No 2 poles required. IMO there not required for a service upgrade but we would install them anyway.
