NEC 2017 210.8(B) GFI's other than dwelling

Any leeway here in a commercial setting, Dunkin Donuts prep counter. A lot of equipment either 240 or 208 with twist locks. I am saying they all need GFI protection. The code handbook note is confusing to me. It says the NEC defintion of "kitchen" is an area with a sink and permanent provision for food preparation and cooking. Then it says cord and plug appliances are not permanent while at the same time saying 210.8(B) applies. I would say the receptacle outlet is permanent so everything even farther away than 6' from the sink needs to be GFI, right?
 
I would break it down...

Does it fit the definition of a kitchen? I have argued that those types of installations do not.

That leaves within 6 feet from a sink. That would most definitely apply. As for further I would tend not to agree.

Check with your ahj.
 
If the area can be definied as a kitchen then all need gfci protection. If the area is just for food prep and no cooking then IMO this is not a kitchen
