NEC 210.25(B)

I’m looking at a multi occupancy commercial building with no existing house panel for parking lot lighting. Would it be a violation of the intent of NEC 210.25(B) to add a sub panel for the lighting branch circuits utilizing a sub metered feeder supplied by a tenant panel?
 
As I read the section, I would say yes it is. As I understand it, the reason for that section is that if the tenant moves out and the power co discontinues service, out go the "common area" loads.

BTW, nice to see a fellow Chicagoan out here!
