NEC code for GFI breaker availability

Guys, as everyone knows right now some breakers are becoming impossible to acquire. Our biggest issue right now is with 2P 30a GFI breakers. I had a fellow electrician tell me that codes says if the manufacturer (Eaton in this case) provides a letter stating the GFI breaker is not readily available then we can install standard breakers so we can pass inspections. Can anyone confirm this is in the 2020 NEC code book? If so, what section is this exception written?

The only thing that even comes close to saying that is the last part of 90.4, but that only applies to a requirement for new equipment that does not yet exist.
90.4 ... This Code may require new products, constructions, or materials that may not yet be available at the time the Code is adopted. In such event, the authority having jurisdiction may permit the use of the products, constructions, or materials that comply with the most recent previous edition of this Code adopted by the jurisdiction.

No AHJ has let us temp CO even without GFi’s. We build restaurants mostly. Had a brand new one sit empty for 2/mo last year because Square D couldn’t get the GFI’s. We have a healthy stock in our own warehouse right now because every single job is still shipping short GFI breakers.

Unless protecting a 12" trench, use GFCI-disconnect enclosure within site of the 30A equipment.
