I own a condo on the second floor of a two-story building. Due to the recent storm, a contractor has come in to make repairs for all the units. They removed the ceiling drywall and insulation. When the condo was constructed, they ran all the electric in intermediate metal conduit which serves as the grounding chassis. The fans were wired with romex and grounded inside the steel gang box. The general contractor says thats "illegal". I'm a professional engineer and do alot of electrical design. I don't believe he's correct. Can someone point me in the direction of where this would be covered in the NEC.

The NEC is a permissive code that allows that which it does not prohibit.

Ask what NEC article prohibits this procedure or requires something else.

Who is the electrician? This is existing and passed inspection when built?
 
Your electrician would know, not the GC. But in general, this is allowed unless a local code prohibits it. Is he possibly talking about the boxes being covered up in a ceiling?
 
If you asking about the use of wire EGC from the equipment terminated onto the box and not extending as a wire conductor back to the panel, as long as the IMC is continuous back to the panel and has continuity the entire circuit is grounded. So should be no problem. If however the concern is the use of Romex, that could be limited by structure type and occupancy.
