Is there a situation where the NEC doest apply?
I'm headed to a Job site where contractor is saying its ok to parallel bkrs because they are still in the construction phase and that its only being done to prove power loads.
I'm not an NEC expert but that just seems off to me.

The situations to which the NEC does not apply are listed in article 90.2(B). The situation you are describing is not on the list, and indeed article 240.8 explicitly forbids it. Being in a construction phase changes nothing. Your instincts serve you well.
 
It's not uncommon for GCs and even other trades to convince themselves of facts not in evidence about electrical work because it is convenient for their scheduling. An EC must be the one to resist that and stand up for the truth in these situations, because what we deal with involves the lives and safety of all of the other trades working on the construction, not just the success of the project.

Whether or not NEC applies depends on laws of the jurisdiction, but if they adopt an unedited non amended NEC as the law - then what you suggested is not in accordance with NEC.

There is section 590 that gives you some allowances not ordinarily permitted in general for temporary installations, it also has some more restrictive requirements for some temporary installations then what is generally required.

Why not just replace a breaker with a larger one, assuming that the circuit conductors' ampacity is sufficient to be protected by the larger breaker. If it's not, then they have other problems.
 
Just out of curiosity, can I ask you to correct one word in your original post? The word "prove" doesn't make sense, and I am not able to understand what the contractor is trying to do.
