Need more breaker space

Hi
The question I have is, I need more space in a sub panel that is fed with 90 amps. I'd like to do away withe the current one and use a 40 space which only comes in 150 or 200. The panel will still be protected by the 90 that comes out of a 200 main. Does anyone see why an inspector might have a problem with this?

There is no rule against that.

However the inspector code ask for load calculations.
