New 480v Mcc installation in Existing industrial motor control center Building

Regarding application of condition 2 working clearances allowed by 2020 NEC 110.26 (A) (1) (c) for Existing Buildings.

A new 3ph 480v mcc is proposed to be installed across (face to face), from an existing 3ph 480v mcc inside of an existing industrial motor control center building.

This location would result in more than 42" clearance between the Mcc's but less than 48" which would normally be required by Table 110.26 (A) (1) condition 3.

The written procedures in this facility clearly only allow qualified electricians to service this equipment.

So, while It is clear that reduction of working space to condition 2 is allowed when replacing an existing piece of equipment, (such as an 480v mcc) can this also be interpreted to allow the installation of new equipment (not replacing existing) as described within an existing building?

As an inspector, I would not permit the proposed installation. You need to find a way to provide the required work space.
As a contractor, I would refuse to make the installation.

AHJ for facility feels this installation will be compliant. Any others agree?
I would make them issue something in writing that they are knowingly allowing a code violation.

90.4 excerpt

By special permission, the authority having jurisdiction
may waive specific requirements in this Code or permit
alternative methods where it is assured that equivalent objectives
can be achieved by establishing and maintaining
effective safety.[/90.4]
The problem I see is that I can't envision a way to assure that equivalent objectives
can be achieved by establishing and maintaining effective safety in reducing clearances.

The ahj can make an exception to the rules usually by special permission. There are some weasel words around special permission you have to meet. Ask for it in writing. My guess is the guy telling you this is not the ahj and is not going to put it in writing
