I took a CEU class today and spoke with Suzanne Borek from the Division of Consumer Affairs. She stated that the adoption of the 2008 NEC is on the governor's desk and should become law in the next week or so. She mentioned a target date of February 20, 2009.
She also noted that all permits filed after the date of adoption would be under the 2008 NEC unless it were stated on the permit that the job is being filed under the 2005 NEC. There will be a six month grace period in which the permits may be filed under the 2005 if the EC so chooses. This allows for permits to be issued on jobs that may already be in the bidding phase or for plans that have been drawn up, but the permits not yet issued, that were done so under the 2005.
She also mentioned that one can keep up to date by visiting the DCA web page for official information regarding the new code. There are a few things that the state has modified from the 2008 NEC, that information can be found there as well.
