New Panel

Is there anything wrong code wise,with installing a new main breaker panel when there is an existing disconnect in place that would be feeding this new panel in a residential dwelling. I know installing a main lug panel would be another option but i was just wondering.

No problem with a redundant breaker/disco at all.

not a problem at all the main breaker in many cases will double or more the cost of the panel vs a main lug panel would be my reason to use main lug panel.

No Problem. I have seen some electric ans do so as to provide the customer with a convenient "main" when the disconnect is not as accessible (such as the panel in the living area, the disconnect in the basement)

Thanks for responses . This was part of a long story that I didn't want to bore you guys with,but this was a debate between two guys at work the other day. I just sat there amused by the whole thing.
