New rules in Ohio

Here are a couple of new rules in Ohio:

"You cannot use your license to pull permits for your unlicensed competitors."

"If you pay your help who perform any of the 5 specialty trades by a 1099,
then they are designated as independent contractors and they must be
licensed."

Chances are the vast majority of people being paid under a 1099 arrangement were not "legal" anyway. If someone is "your help", he is an employee and not an independent contractor.

Im having problems having my Licensed competitors showing up and doing unpermitted work on my jobs while Im there.

In FL the rule of thumb is if you write them a pay check your license covers them. If you 1099 them, then they are not your employee and hence not covered by your license. Day labors can dig the ditch but cant put the pipe in or pull the wire. If its in the NEC they cant do it without a qualifier. A qualifier is someone licensed by the state and registered with the state for a given corporation LLC Partnership or sole proprietor. Then they get a paycheck and that makes it ok. They also have to be available to communicate with. If the crew has a cell phone thats AOK no mater where they are or who they are!

Go figure.

They just show up and start working?

It would appear to me that if it is your job, you would be in control of who is working on it.

Or are you refering to "your job" as a job site where you are doing some part of the work and others are doing other parts?
 
just what we need , more rules! It's worked so well so far driving real business and real jobs from over regulated and over taxed areas of our country. How are things in Ohio?

I would think with all the jobs lost due to GM and AK Steel lockout several years back ( some employees not returning ) there is alot of 1man shows popping up but either way this is the worst I have seen in 25 years
