New structure over an underground lateral feed

I have run this by the Bldg inspector and the Electrical Inspector they use.

I want to build a Garage, needing a "monolithic slab" foundation. Or something like that. The place I want to build it is over the existing main feed to the house. Not certain how deep, as yet. Dig Safe is coming out to map it, but I don't know they can tell the depth.

Initially, the EI said "no way". But after some discussion, it became a "common sense" discussion. Well, I have never been accused of having much of that. So digging a bit more on my own, came up with this (oddly enough found on this site) which seems to give me some leeway.

230.3 Pass Through a Building or Structure

Service conductors cannot pass through the interior of another building or other structure.

230.6 Conductors Considered Outside a Building. Conductors are considered outside a building when they are installed:
(1) Under not less than 2 in. of concrete beneath a building or structure.
(2) Within a building or structure in a raceway that is encased in no less than 2 in. thick of concrete or brick.
(3) Installed in a vault that meets the construction requirements of Article 450, Part III.
(4) In conduit under not less than 18 in. of earth beneath a building or structure.

Author?s Comment: Service conductors must not be installed inside a building [230-70(A)(1)], but if the raceway is below a building, the service conductors are considered outside the building. Figure 230-4 230-06(1).cdr


So, if I can clear the conduit/raceway with the foundation (vertically) would I be legal?
